Delhi High Court Grants Emami Agrotech Interim Relief Against FSSAI Action
The Delhi High Court on 15 October 2026 granted interim relief to Emami Agrotech Limited, directing FSSAI not to take any further steps on a Show Cause Notice dated 5 June 2026 and an FSSAI letter dated 17 July 2026 issued to food safety authorities across the country. The order was passed by Justice Amit Mahajan in W.P.(C) 15491 of 2026 and will hold until the next date of hearing.
The Show Cause Notice alleged that Emami's registered brand name "Emami Healthy & Tasty", used for its edible oil range including sunflower oil and kachchi ghani mustard oil, is misleading and contravenes various provisions of the Food Safety and Standards Act, 2006 and the regulations framed under it.
Based on that notice, the 17 July letter instructed Commissioners of Food Safety nationwide to start enforcement action and take steps to ensure Emami's products, among those of other food business operators, are not manufactured, distributed, marketed or sold.
Emami challenged these actions by FSSAI on the ground that they were not in accordance with law.
Emami Agrotech was represented by Senior Advocate Sandeep Sethi, briefed by Partners Smarika Singh and Saifur Rahman Faridi, along with Senior Associate Jasneet Jolly and Associate Ridhima Bhardwaj of Shardul Amarchand Mangaldas & Co.
The firm recently secured relief for Emami before the Calcutta High Court against action by FSSAI Kolkata.
