NMC Scraps 2023 Medical Education Standards Rules, Keeps Annual Disclosure Report Filing

24 Oct 2026 · Legal News · By LawQuorum

The National Medical Commission (NMC) has withdrawn the Maintenance of Standards of Medical Education Regulations, 2023 (MSMER-2023). The de-notification was notified on 14 October 2026 and takes effect from 16 October 2026.

The regulations were originally notified on 19 September 2023 and published in the Gazette on 21 September 2023. The de-notification has been issued under Sections 10, 24, 25 and 57 of the National Medical Commission Act, 2019.

Even though MSMER-2023 has been scrapped, medical institutions will still have to file the Annual Disclosure Report (ADR). The NMC said this requirement continues under Sections 24(i) and 25(h) of the Act, along with the regulations applicable from time to time.

The de-notification comes with transitional and saving provisions to protect existing rights, obligations, approvals and pending proceedings. Any action validly taken under MSMER-2023 before it was withdrawn will remain unaffected. Approvals, renewals, orders, decisions or directions issued earlier will continue to be valid. Rights, privileges, obligations or liabilities that were acquired, accrued or incurred before the de-notification will also not be affected.

Applications, proceedings, appeals, inquiries and other matters that were pending on the date of de-notification will continue to be handled under MSMER-2023, to the extent applicable. Matters arising after the de-notification will be governed by the National Medical Commission Act, 2019 and the statutory and regulatory provisions in force at that time.
